Man indicted for illegal re-entry after conviction

— MUSKOGEE – A Tahlequah man was indicted this week by a federal grand jury meeting in Muskogee.
Fabian Salinas Eligio, 23, was indicted by illegal re-entry of a previously deported alien after conviction of an aggravated felony. Salinas-Eligio was deported from the U.S. through a Del Rio, Texas, port of entry. Salinas-Eligiio didn’t seek permission to re-enter the country.
U.S. Attorney Sheldon Sperling said Salinas-Eligio was interviewed and admitted being an illegal alien on Oct. 29, 2008. He also admitted coming back into the country after being deported following a first-degree rape conviction.
The charge stems from an investigation by the U.S. Department of Immigration and Customs Enforcement. Salinas-Eligio faces imprisonment for up to 10 years and/or up to $250,000 in fines.
A grand jury indictment is a means of filing formal charges against a criminal defendant and is not evidence of guilt. He may only be convicted if evidence proves his guilt beyond a reasonable doubt.
