Judge orders no bond for man charged in burglary, assault case

A judge Friday ordered a Tahlequah man held without bond after his arrest on burglary and assault charges.

Jose Luis Garcia, 29, was before Associate District Judge Mark Dobbins Friday morning. He is formally charged with first-degree burglary, assault and battery with intent to kill and assault and battery with a deadly weapon.

Tahlequah police arrested Garcia Thursday morning after Officer Clay Mahaney answered a call of a woman bleeding from the head at a local residence. Officers James Johnson and Elden Graves as well as Lt. Clint Keys also responded. TPD Detective Lt. Dale Glory and Detective Chris Boals were summoned to conduct the investigation.

Reports state Garcia forced his way into Amie Garcia’s home and cut her throat with a knife and also cut Tim Cannon with the knife. The report lists Cannon as Amie’s boyfriend.

Cherokee County court records show Jose Garcia was placed on a suspended 10-year sentence just two weeks ago on charges of intimidation of a witness and possession of a firearm after former conviction. He has a conviction in a 1999 case of assault and battery with a deadly weapon.

First-degree burglary is punishable by imprisonment for seven to 20 years and each of the assault counts carry possible life terms. Garcia was ordered to return to court June 10.

Assistant District Attorney David Pierce is prosecuting the case.
