Tahlequah’s Board of Adjustment voted Thursday to allow a four foot exception to the rear/side yard set back regulations for a local property owner. Tyler Ashley told the board he thought he was within the requirements and was doing what was right. Ashley is building a detached garage on his property at 101 N. Mission. Building Inspector Joe Williford said the property is at the corner of Delaware and Mission. He said set back regulations require Ashley to stay 5 feet off the alley right-of-way and the corner of Ashley’s garage is a foot off the right-of-way. “The corner of his building is in the set back,” Williford told the board. The building doesn’t impede any traffic through the alley. No one else appeared at the meeting to speak for or against the exception. All four board members in attendance, Drs. Tom Cottrill and Mark Smith and Gary Gore and Carter Waldron, voted to grant the exception. Dr. Charles Carroll, the board’s fifth member, was not at the meeting. The Board of Adjustment meets as needed in the council chambers at City Hall.
