Published August 27, 2008 08:39 am - Man who didn't show up for court to be arrested By BOB GIBBINS TAHLEQUAH DAILY PRESS — A bench warrant was issued Tuesday afternoon for a rural Stilwell man who allegedly failed to appear for an arraignment in Cherokee County.
Tyler Lewis Presley, 23, was free on a $10,000 bond and scheduled to appear at 1 p.m. Tuesday before Associate District Judge Mark Dobbins. Dobbins issued the bench warrant and set a new $25,000 bond when Presley didn’t show. Court records indicate Presley was formally charged this week with feloniously pointing a firearm, possession of controlled drug and public drunk. He allegedly pointed a Browning 9mm handgun at Clint Davis and Kevin Tunnell on Aug. 9. He also allegedly had Xanax at the time and was intoxicated. The possession count is filed as a misdemeanor and carries a possible year sentence and a fine of up to $1,000. The felony count is punishable by imprisonment for one to 10 years. The charges were filed after an arrest by Oklahoma Highway Patrolman Rodney Vick, records show. Assistant District Attorney Josh King is prosecuting the case.
