A Tahlequah couple facing child-neglect charges pleaded not guilty Tuesday in district court.
James A. Cosby, 23, and Ashley N. Cosby, 23, were charged last month after their 1-year-old baby reportedly ingested some of their marijuana.
James A. Cosby also is charged with possession of a controlled dangerous substance and obstructing an officer.
Police said they were called to a Tahlequah hospital after the boy was taken in and was later transferred to a Tulsa medical facility. Medical personnel said the boy tested positive to ingesting tetrahydrocannabinol, or THC.
James A. Cosby allegedly told police the boy had been with someone else that day.
When detectives went to the Cosbys’ home the following day, it allegedly smelled of pot, but James initially denied there was any in the home.
He later led police to a bag of marijuana under a bathroom sink, near the child’s bedroom.
During subsequent interviews, the Cosbys allegedly told police they had been smoking marijuana in their home.
Some of the weed may have been separated on the floor in their living room and left behind where the child could reach it, court documents indicate.
The couple is out on bond and is set to be back in court Dec. 3 for a felony sounding docket. Court records show the Cosbys are represented by Tahlequah attorney James Simms.
