Offender charged with failing to register

TAHLEQUAH — Prosecutors have filed charges against a convicted sex offender accused of failing to register in accordance with the law and trying to avoid arrest by giving false information.

Larry Delane Clayton, 56, is formally charged with failing to register under the Sex Offender Registration Act; being a sex offender and living with 2,000 feet of a park; and obstructing an officer.

According to a probable cause affidavit filed by Cherokee County Sheriff’s Investigator James Brown, Clayton was convicted of first-degree rape and incest nearly 20 years ago, and must register with authorities every 90 days.

Brown learned Clayton last checked in with authorities in Adair County on Sept. 8, 2011. Investigators later learned Clayton was living near Willis Road, in a residence Brown said was less than 2,000 feet from a daycare and an elementary school.

Clayton was found earlier this month at a Tahlequah casino and allegedly gave authorities a false name in an attempt to avoid being arrested.
