Prosecutors have charged a Tahlequah woman who was allegedly caught multiple times throwing trash onto another property owner’s land.
Margie Burkhart, 50, is charged with three misdemeanor counts of dumping trash on public or private property.
According to court documents, Burkhart dumped the trash on the property of Chris and Andrea Cape on Lowe Drive last May.
A report prepared by Cherokee County Undersheriff Jason Chennault says the Capes first reported to deputies last May that Burkhart would drive by their home at high rates of speed and toss trash from her vehicle onto the Capes’ property.
The couple provided written statements and video that reportedly shows Burkhart throwing the trash out, but the deputy who took the report left the sheriff’s office for a job in the District Attorney’s Office, and charges were never filed.
Chris Cape contacted the sheriff’s office recently to check on the case, and Chennault forwarded the report to the DA.
If convicted, Burkhart could face up to 30 days in jail and a fine of $200 to $5,000 for each charge.
