Man pleads to indecency charge

TAHLEQUAH — Prosecutors entered into a plea agreement Wednesday with a 20-year-old man accused of having sex with a 15-year-old girl last year.

Jorge Landaverde was charged with felony second-degree rape last August, when he was 19. But this week, Landaverde’s charge was reduced to a misdemeanor count of outraging public decency.

Landaverde pleaded no contest to the reduced charge and was given a two-year deferred sentence, along with fines and costs.

He will be under supervision of the District Attorney’s Office for two years, and must get a sex offender evaluation and follow any recommendations resulting from that evaluation.

Cherokee County Undersheriff Jason Chennault said last August that the 15-year-old girl initially claimed she had been raped, but later admitted she was a willing participant with Landaverde.

She claimed she lied, according to investigators, because she didn’t want to upset her mother, who had apparently found out about what happened.
