Published July 03, 2008 09:51 am - Judge issues order in LREC suit By BOB GIBBINS TAHLEQUAH DAILY PRESS — MUSKOGEE – The judge presiding over a lawsuit filed in federal court against Lake Region Electric Cooperative officials has suggested supplementation of the case brought by five of the cooperative’s members.
Court records show U.S. District Judge Ronald White suggested the RICO (racketeering) case statement filed by Michael and Sherry Linehan and Delisca, Ralph and Kathleen Cole be supplemented by July 18. The Linehans and Coles have made a series of allegations against the cooperative’s board members Gary Cooper, Lynn Lamons, Kenneth Shankle, Jack Teague, Jim Loftin, Bobby Mayfield and John Hopkins, and CEO Hamid Vahdatipour. Attorneys for the board and CEO have denied the allegations, and asked White to dismiss the case. The court has also ordered to discuss what exactly are the plaintiffs claims and allegations. The suit was initially filed against the cooperative and then amended to individually list the board members and CEO. The Linehans and Coles have also been given until July 9 to respond to the motion to dismiss and then the board and CEO has been given until July 30 to reply to the response. White has set the case on the March 2009 jury trial docket with an estimate the case will take five days to try. Each side will be allowed to take 15 depositions in the case, but may not start depositions until after Aug. 15. Donn Baker and Eric Turner represent the LREC board and CEO. Corrine O’Day represents the Coles and Linehans.
