MUSKOGEE – A local man who fled from authorities trying to serve a federal arrest warrant on him earlier this year is able to assist his attorneys in his defense.
Vance Wade Moore’s federal charges for assaulting a police officer, possession of a firearm during a crime of violence and being a felon in possession of a firearm have been “on hold” since March when U.S. District Judge Ronald White ordered a competency evaluation. Earlier this week, White issued a ruling that Moore, 37, was able to understand the nature and consequences of the proceedings against him and assist attorney Terry Weber with his defense.
A psychological report concerning Moore’s evaluation is being kept under seal as a court exhibit.
Neither the defense nor the prosecution presented any other evidence and entered a stipulation concerning the report.
Weber told the court he believes Moore is incompetent to stand trial and requested additional time to file the appropriate motions. White ordered him to file written motions regarding his requests.
Moore ran from his home when sheriff’s deputies, federal marshals and other law enforcement personnel arrived to arrest him on a federal firearms charge. He spent the night in the woods and was arrested the next day.
Moore has state court convictions on rape and drug charges.
Assistant U.S. Attorney Chris Wilson is prosecuting the case.
