Published July 18, 2008 12:39 pm - Judge bars record of woman suing for unlawful cavity search By BOB GIBBINS TAHLEQUAH DAILY PRESS — Attorneys for the city of Tahlequah and Cherokee County Detention Center won’t be permitted to present evidence on a local woman’s previous criminal history at an upcoming federal civil trial.
U.S. District Judge Ronald White ruled Thursday that defense attorneys can’t speak of Christie Vaughn’s prior record. Vaughn is suing the city and CCDC for an alleged violation of her civil rights and an unlawful search. Vaughn was subjected to a strip search at the Tahlequah Police Department and cavity searches after she was taken to CCDC. Her attorneys, Jim Cosby and Crystal Jackson, filed a motion earlier asking the court to disallow use of their client’s record by the defense. White said the city and CCDC can resubmit their request to use Vaughn’s record after the trial starts. Jury selection is scheduled to begin at 9 a.m. Aug. 4, and it’s been estimated the case will take two days to try. In a related matter, Cosby and Jackson filed a second suit Thursday morning in Cherokee County District Court against eight individuals allegedly involved in either the strip search or the cavity search of Vaughn. CCDC Administrator Loyd Bickel and CCDC employees Cindy Matthews, Beth Collins and Sylvia Holmes were named as defendants, along with Police Chief Steve Farmer and TPD employees Chandra Hickey, David Huffman and Misty Davis. The suit alleges Vaughn was arrested after a May 24, 2007 traffic stop. The strip search failed to yield any contraband. The attorneys also allege the cavity searches at CCDC were performed in a non-sterile environment without proper medical training, supervision and safety precautions. Vaughn seeks actual and physical damages in excess of $10,000, court costs, attorney fees and interest.
