Published September 03, 2008 09:41 am - Third woman says cop assaulted her By BOB GIBBINS TAHLEQUAH DAILY PRESS — HULBERT – A third woman has come forward seeking damages from the town of Hulbert for the alleged illegal actions of former Hulbert police officer Jonathan Baldree.
The woman contends in a tort claim that she was wrongfully held for a long time by officer, who then sexually assaulted her. She states in the claim she never consented to Baldree’s conduct. The incident allegedly occurred on or about Jan. 1, when the alleged victim was stopped at a convenience store in Hulbert. She says she was falsely arrested and taken to the Hulbert Police Department. The woman’s attorney, Jim Cosby, claims the town of Hulbert knew or should have known Baldree was sexually assaulting female citizens, but didn’t take action to prevent injuries to victims. Cosby also says Hulbert is negligent in its hiring practices, training and supervision of its employees, and in its failure to prevent injury to the woman. The town of Hulbert, and all employees or agents of the town who “acted with intentional and/or negligent conduct” regarding this incident, are considered defendants in the action, along with Baldree. The woman seeks damages in excess of $10,000. Two other women filed tort claims last month against the town of Hulbert for improprieties allegedly committed by Baldree while he worked as a Hulbert officer. In May, Baldree was criminally charged with public official neglecting duty. He was granted a deferred two-year judgment after pleading no contest.
