Man accused of extreme spanking faces new charges

TAHLEQUAH — jnewton@tahlequahdailypress.com

A Cherokee County man accused earlier this year of spanking a 12-year-old boy 20 times with a wooden paddle is facing new charges for allegedly hitting another boy.

Damon Ashley Shirrel, 32, of Rose, is charged with child abuse by injury, the second time in three months he has been charged with that offense.

Cherokee County Sheriff’s Deputy Charles Dreadfulwater filed a report on the latest incident July 20. The alleged victim’s father said details of the incident surfaced when his boy returned home from Shirrel’s house, where he’d been staying for several days.

The boy claimed he was struck in the arm by Shirrel when Shirrel asked the child if he wanted to play a game called “Frog.”

The boy allegedly told Shirrel he did not want to play, but Shirrel punched the 10-year-old in the upper arm with his fist. The child told deputies that the punch hurt and left a bruise.

By the time the boy returned to his father’s home and told him of the incident, the spot of the injury was only slightly discolored, Dreadfulwater reported.

Shirrel was arrested in May for allegedly spanking a 12-year-old boy with a wooden paddle 20 times as punishment for lying.

Prosecutors said the paddling left bruises on the child. Shirrel pleaded no contest in late June and received a five-year suspended sentence.

Court documents show Shirrel’s previous convictions also include unlawful distribution of controlled drugs with intent to distribute, and possession of a firearm during commission of a felony.

A warrant has been issued for Shirrel’s arrest, records show.
