Charges filed in veteran’s case


TAHLEQUAH — Prosecutors have filed charges against two men accused of stealing a veteran’s American flag on Veterans Day and hitting him with a vehicle.

Dakota Wayne Choate, 21, of Sallisaw, was charged with second-degree burglary of an automobile and public intoxication. Jesse H. Bennett, 24, of Tahlequah, was charged with assault and battery with a deadly weapon, knowingly concealing stolen property, and inattentive driving.

Tahlequah police responded after the duo allegedly stole the flag from Russell Boyd Jr.’s truck on Nov. 11 outside of Ned’s in downtown Tahlequah. Prosecutors allege Bennett and Choate then fled in a vehicle, striking Boyd and hitting a Nissan belonging to Devin Basinger near Morgan and Muskogee.

According to police, Boyd was not seriously injured from being hit by the fleeing suspects.
