Drug items found in baby’s play room; man arrested

TAHLEQUAH — Tahlequah police jailed a Fort Gibson man this week after finding drug paraphernalia and stolen property inside a baby’s play room.

Danny Ray Kirk Jr., 21, was held on anticipated charges of possession of a controlled dangerous substance, possession of paraphernalia, and knowingly concealing stolen property.

Tahlequah Officer David Craig’s arrest affidavit says officers went to a residence on West Allen Road Sunday to check a child’s welfare.

Police found the girl’s mother and two men – one of them being Kirk – at the home.

The woman gave police permission to search the home for illegal substances, according to Craig.

Kirk went to the baby’s playroom to get his identification, and Craig followed.

Craig said he noticed a blue bag in the baby’s playroom, and all three who were in the house denied it belonged to them. Craig looked through the bag and found a laptop computer, digital photo player, plastic bags with a white residue, glass pipes, a straw, syringes, a casino card with Kirk’s name on it, and a photo ID of Kirk.

Kirk allegedly told officers he would talk if it would help him, because he is on probation.

Kirk then confessed ownership of the bag and all items inside of it, and told police the laptop and digital photo player was stolen property he had received from another man.

Court records show Kirk was arrested in June after he allegedly burglarized a home garage and auto-repair garage.

Police said Kirk stole a motorcycle, torch set, fishing poles, hand tools, automobile paint sprayers, tents, an air compressor and more. Some of those items were recovered when Kirk was arrested by detectives.
